What Type of Institutions are Regulated?

Examples of regulated institutions include: hospitals, clinical laboratories, veterinarians, funeral homes, nursing homes, home health providers, physicians offices, research laboratories, pharmaceutical companies, colleges and universities (including basic medical or clinical microbiology laboratories), blood banks, company infirmaries, correctional facilities and waste management companies.

NYS Medical Waste Regulatory Authority and Jurisdiction

In the early 1980s, New York State started regulating regulated medical waste and has adopted a comprehensive regulatory framework covering all aspects of handling, storing, treating and disposing of this waste. In accordance with the Public Health Law 1389 aa-gg and 10 NYCRR Part 70, Title 15 of Article 27 of the Environmental Conservation Law, Subparts 360-10 and 360-17, and Part 364 regulate the activities of the regulated community in New York State.

New York State’s regulated medical waste Program is jointly administered by the Department of Health (DOH) and the Department of Environmental Conservation (DEC). A hospital, freestanding diagnostic and treatment center, residential health care facility, or clinical laboratory is regulated by the DOH. As well as developing treatment standards, the DOH also approves alternative treatment technologies. To evaluate alternative RMW treatment systems and classify present and emerging RMW treatment technologies, DEC staff collaborates with DOH.

The DEC has supervisory authority for all storage, handling and destruction processes located at facility sites not under the jurisdiction of the DOH (unless such facility is considered a commercial operation), for offsite transportation of RMW, for all generators, monitoring, responding to illegal disposal incidents and for all external storage, transshipment, handling and disposal facilities. This additional supervision, as required by the legislator, is necessary to ensure that all RMW generators operate to the same standards.

NYS Regulated Medical Waste Management Practices

New York State produces approximately 36,000 RMW generators and 250,000 tonnes of RMW each year. One-third of this amount is occupied by medical facilities such as nursing homes, hospitals and laboratory laboratories, and the remaining two-thirds is occupied by clinics, blood facilities, universities, veterinary and dental clinics and funeral halls. Most medical waste is discarded during generation.
